Powys Country House Terms and Conditions
1 BOOKING YOUR VACATION
a) When booking your vacation an agreement is reached between Powys Country House and the signatory of your booking documents, who must be over 18 years of age.
b) The booking procedure is available on our website.
c) The booking contract between Powys Country House and the signatory of the booking documents will be governed by Powys Country House booking conditions and applicable United Kingdom Law.
d) A booking is confirmed once Powys Country House has received booking confirmation 500 GBP deposit.
2. TERMS OF PAYMENT
a) All payments are to be made in Pounds Sterling
b) 500 GBP deposit to be paid on booking by bank transfer.
c) Your security bond of 500 GBP is to be paid within 48 hours of arrival.
Guests will not gain entry without deposit being paid. It will be fully refunded into your account 3-5 days after departure providing there are no damages, theft, hot tub abuse, extra cleaning or laundry etc. You will be notified ASAP of any problems. Should we require professional services we would supply an estimate/receipt for work or any item replacement.
Deposit is not applicable to guests booking individual cottages, however damages are to be paid.
c) Remaining booking cost to be paid 8 weeks prior to arrival or immediately if booking is made within 8 weeks of arrival.
3. LATE PAYMENT & DAMAGE DEPOSIT
Powys Country House has the right to regard the booking as cancelled if any of the outstanding payments are not paid on time, and shall be entitled to retain the amounts already paid in.
4. CANCELLATION BY THE CLIENT
a) Bookings can be cancelled with at no cost 8 weeks before arrival.
b) Should Powys Country House need to cancel your booking, we will give you as much notice as possible and refund all money paid.
Powys Country House cannot be held responsible for any cancellations and subsequent costs due to issues with flights or any other forms of transportation that might impact your arrival at the establishment.
5. CANCELLATION BY Powys Country House
In the unlikely event that, due to circumstances beyond the reasonable control of Powys Country House the room(s) ceases to be available as booked, they will refund the Client all the money paid to Powys Country House without delay and shall be under no other liability.
We reserve the right to cancel last minute should we incur any major problem, such as flood, fire, electrical or heating breakdown (i.e., things that are out of our control)
6. CLIENT RESPONSIBILITIES
a) It is the responsibility of the booking signatory to ensure that each member of the group holds the appropriate insurance. In addition any member of the group who has specialist insurance needs is required to have these in place for the booked vacation period.
b) It is the responsibility of the signatory to advise us in writing of any allergies suffered by any member of your group. Powys Country House will ensure that every care is taken in respect of allergies but cannot be held responsible for the behavior of others in the group or externally in relation to those allergies, nor can they be held responsible for air born allergies beyond their control whether internal or external to the chalet. It is the responsibility of the individual with allergies to have the appropriate medication with them and to take care to minimize their own risks.
c) We would expect you to treat the property with care and respect. Should you lose, break or damage anything on the premises please advise the owners. We expect you to leave the property in the same general order in which it was found.
d) As a part of your vacation members of your group may decide to partake in additional chargeable services. As part of the contract you hereby agree to guarantee personal payment of these services to the external providers as required before or during your stay.
7. POWYS COUNTRY HOUSE RESPONSIBILITES
a) Powys Country House is responsible to ensure that the vacation booked with our company is supplied as described in the website and on the booking information.
b) Powys Country Hosue assumes responsibility for any loss, death, injury or illness caused by the gross negligent acts and/or emissions of Powys Country House employees, whilst acting within the scope of their employment in the provision of your vacation, except where failure to perform or the improper performance was due to:
• Your own acts or omissions
• Acts or omissions of a third party not involved with the provision of your vacation
• Circumstances which were unforeseeable or unavoidable even when exercising all due care
c) Powys Country House shall not be liable for any loss, breach or delay due to any cause beyond their reasonable control including though not limited to an act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by-laws, or measures of any kind on the part of any governmental or local authority, strikes, lock-outs, or other industrial actions or disputes or adverse weather conditions, or force majeure reasons. In all such cases they shall be entitled to treat the contract as discharged. In the event of such discharge the liability of the Powys Country House shall be limited to the return of sums paid to them in respect of the unused portion of the holiday calculated on a pro rata daily basis.
d) Powys Country House cannot be held responsible for the breakdown of any piece of mechanical or electrical equipment, for example TV, internet, pumps, boilers, etc. nor for failure of public utilities such as water, gas and electricity; however every effort will be made to repair these in a timely fashion.
e) No responsibility can be taken regarding public utilities outside the control of Powys Country House.
f) No liability is accepted on the part of Powys Country House for any loss, damage or theft of personal items, either within or beyond the boundaries of the holiday accommodation; but all efforts will be made to secure the property.
8. ADDITIONAL ACTIVITIES
It is the responsibility of the client to judge the suitability to each person of any additional activities offered by Powys Country House and to have the appropriate insurance in place to undertake them. Whether the activity is recommended by Powys Country House or one of our representatives or a 3rd party, we are not liable for any injuries howsoever caused.
9. HEALTH, VISAS, PASSPORTS AND OTHER KEY DOCUMENTATION
It is the responsibility of the client to ensure that all documents are in proper order before the party travels. Powys Country House accepts no liability for any monetary losses or inconvenience caused as a result of your failure to take reasonable care in this respect.
10. TRANSPORTATION TO AND FROM THE VACATION VENUE
a) Powys Country House cannot accept responsibility for guests missing flights or for issues with other transportation or for mislaying or destroying travel documents. No credits will be given if you fail to take up a portion of your vacation as a result of any of the above.
11. ARRIVAL & DEPARTURE
Our Check in time is from 16:00 in the afternoon on the date of arrival. The checkout time is 11:00 on the date of departure. Please contact us if you want to leave at another time on the date of departure, so we can make arrangements. If you have to cut short your holiday no refund can be made for the days unused.
12. INFORMATION.
Whilst we make every effort to ensure that descriptions supplied are accurately reproduced, we cannot accept responsibility for errors or omissions contained therein or the results thereof. Minor differences between photographs and text and the actual property may arise. Information about the resort facilities is printed in good faith but we are unable to guarantee that all will be available at all times.
13. JURISDICTION
This contract in made on the terms of these booking conditions that are governed by UK Law.
14. ADDITIONAL AND MISCELLANEOUS TERMS
a) Hot Tub: Whilst every effort is made to keep it maintained and in good working order, it is inevitable that it will break down occasionally. We would try and fix any problems, but we cannot guarantee this.
Strict 11pm finish or hot tub may be disabled and you would lose your security deposit.
b) Housekeeping: You will find everything spotless on arrival. We expect the house to be left clean and tidy. Charges will be made for dirty saucepans, meat tins, grill pans, BBQ, Pet hair on bedding and furniture, muddy paw marks, dog poo around grounds, not recycling of food waste/plastics.
c) Guests who add more guests and exceed maximum limits of guests will be asked to leave and will be charged.
d) We do not accept 18th, 21st, 30th birthday parties or stag/hen groups. If this is found to be the case you will be asked to leave and will receive no refunds.
e) Dogs: A maximum of 2 dogs are allowed at 10 GBP per night per dog or 50 GBP per week per dog – please contact us prior to arrival if you plan on bringing a dog.
